Objeto y extensión del derecho agrario

En el presente trabajo se parte de una caracterización del derecho agrario como regulador de la actividad agraria y, a partir de allí, se concluye en la imposibilidad de describir un objeto de la materia con vocación universal, por las influencias geográficas, políticas, históricas y de los ámbitos específicos jurisdiccionales de que se trate. Se describen las cuestiones actuales que hacen ver el objeto del derecho agrario desde distintas perspectivas: el ambiente, los productos, los mercados, las cadenas de producción, la tecnología, la biotecnología, las regulaciones regionales e internacionales, etc. Contenidos que van aportando a la multiplicidad de objetos de regulación y estudio y de amplitud de relaciones y zonas de contacto o conflicto con otras disciplinas jurídicas. Se recuperan los aportes de prestigiosos autores platenses que contribuyeron a la autonomía científica de la materia describiendo la actividad agraria y, luego de ello, se vuelve sobre los puntos de difíciles confines con otras materias, para trazar un punto de vista sobre dichos límites. This paper begins doing a characterization of the agricultural law as regulator of the agrarian activity and, from there, concludes in the inability to describe an object of the matter with universal vocation, for the geographical, political, historical influences and of the specific jurisdictional areas about which it treats itself. It describes some questions in order to face the object of the agricultural law from different perspectives: the environment, the products, the markets, the production lines, the technology, the biotechnology, the regional and the international regulations, etc; contents that are contributing to the multiplicity of objects of regulation, of study and of extent of relations and zones of contact or conflict with other juridical disciplines. In this document we will recover ideas of some prestigious authors from La Plata that have contributed to the scientific autonomy of the Agrarian Law subject. After that, this work will confront some difficult aspects of the Agrarian Law subject which borders with other legal areas. The objective is to develop a point of view about the limit with them.
