¿Existe un sistema judicial internacional? : Sobre la coexistencia de Cortes y Tribunales

En las últimas décadas se ha producido una multiplicación de cortes y tribunales internacionales, generando profundos cambios en el sistema internacional. En el trabajo se argumenta que dicho fenómeno es positivo, y que ha permitido la consolidación de la solución judicial de controversias. Se aborda el tema desde la descripción de la existencia de mecanismos, como lo son el diálogo judicial y la cortesía entre tribunales, que pueden ser útiles para lidiar con posibles consecuencias negativas. La idea que se sostiene es la existencia de un sistema judicial internacional, en el cual los diferentes órganos son conscientes de su papel y buscan mecanismos para evitar conflictos y, a su vez, dar coherencia al derecho internacional. In the last decades the multiplication of courts and tribunals has substantially changed the international system. It is argued in the article that the foresaid phenomenon is a positive one, and that has allowed the consolidation of the judicial settlement of disputes. The topic is approached by describing the existence of mechanisms, mainly judicial dialogue and mutual respect that can be useful to deal with the alleged negative consequences of the phenomenon. The idea that is uphold is the existence of an international judicial system, in which the different bodies are conscious of their role and search for mechanisms to avoid possible conflicts, and to give coherence to international law.
