La práctica penal punitiva y su "hacer mundo": de víctimas y victimarias

Este artículo presenta los resultados de una investigación que tiene porobjeto problematizar los alcances y efectos de la lógica penal punitiva y su “hacermundo”, en función de su carácter intrínsecamente individualizadora y dicotómica/dicotomizante, considerando particularmente los efectos de género. En este sentido,analizamos cómo se problematizó socialmente la judicialización de las experienciasde dos mujeres, Higui y Nahir, prestando especial atención a la forma en que seproducen las adscripciones a los lugares de víctima y victimaria y al modo en que elsistema penal, en tanto aparato socio-tecno-jurídico, produce y reproduce género.
The article presents the results of a research that aims to problematize the scope and eff ects of the punitive logic and its way of “creating a world”, taking into account its individualizing and dichotomic/dichotomizing logic, especially considering its eff ects in terms of gender. In that sense, we analyze how the judicialization of the experiences of two women, Higui and Nahir, was socially problematized paying special attention to the way in which the roles of victim and perpetrator are assigned and the way in which the penal system, as a socio-techno-legal apparatus, produces and reproduces gender.
