El caso Malvinas y la Corte Internacional de Justicia

El trabajo presenta de manera sintética la historia de las Islas (de acuerdo a las distintas fuentes) la posición argentina y británica sobre el archipiélago, un análisis de los derechos de soberanía y a la libre determinación de los pobladores y los antecedentes sobre resolución de disputas territoriales en el ámbito de la Corte. Es imposible llegar a una respuesta definitiva y categórica acerca de quién tiene el derecho de soberanía sobre las Islas Malvinas. Sin embargo, un examen de eventos históricos y de los principios del derecho internacional podría llevar a una conclusión que en las Islas Malvinas pugnan entre dos posiciones una que privilegia los antecedentes históricos y jurídicos (la de Argentina) y otra basada en la ocupación "continua y eficaz" del territorio a lo largo del tiempo. Entre los Casos de disputas territoriales llevados a la Corte Internacional de Justicia existen ejemplo que favorecen tanto una como otra posición, por lo que teniendo en cuenta que las evidencias resultan inusitadamente controvertidas, y que el derecho internacional es un campo en progresiva e incierta evolución, resulta difícil de predecir sobre cual sería su resultado.
This paper presents a brief history of the islands (according to various sources), the Argentine and British claims over the archipelago, an analysis of the inhabitants rights to self-determination and the antecedents of territorial disputes resolutions by the International Court. It seems impossible to achieve a categorical and uncontestable solution as far as the sovereignty rights over the Malvinas are concerned. However, the scrutiny of historical events and of International Law leads to the conclusion that there are two contending positions on the Malvinas issue: one based on historical and legal antecedents (that of Argentina), and another one based on the continuous occupation of the territory over time. There are examples favoring either position among the cases of territorial disputes submitted to the International Court of Justice. Taking into account that the evidence is extraordinarily controversial and that International Law is a field of constant and uncertain evolution, the outcome of this particular case, if taken to the above-mentioned Court, is difficult to predict.
