Los derechos humanos como fundamento del discurso jurídico

Pensar la fundamentación de los derechos humanos, implica entender no solo su sentido dentro del sistema jurídico, como principios constructores sobre el que se apoyan todas las instituciones del derecho, sino que también se relaciona con la posibilidad de reflexionar sobre la finalidad del sistema jurídico, en tanto que marcan la consecución de ideales éticos. El presente trabajo pretende fundamentar filosóficamente los derechos humanos desde las modernas teorías discursivas y la idea de una moral universalista. En tal sentido, hemos profundizado en el estudio de las teorías de John Rawls, Carlos Santiago Nino y Robert Alexy, estableciendo sus similitudes y diferencias, lo que nos permite consolidar una posición, sino también comprender acabadamente su importancia. The foundation of human rights, does not only demand understanding its meaning in the legal system. and the basic principles which are the cornerstone of all institutions of law, but it also requires a deep reflection on the purpose of the legal system as a way of achieving ethical ideals. This paper surveys the philosofical aspects of human rights from the point of view of modern discourse-analysis theory and the tenets of universal ethical ideas. Consequently, the theories of John Rawls, Carlos Santiago Nino and Robert Alexy have been explored, pointing out similarities and differences to support the approach and at the same time looking for a full understanding of the importance of the issue.
