Justicia, emociones y derechos humanos

Los conflictos humanos llevados a la justicia poseen un componente emocional irreductible: sentimos ira ante el daño, temor ante una amenaza y vergüenza ante una humillación. Las emociones morales, por otro lado, se distinguen de las emociones básicas que experimentan otras especies animales no humanas por su contenido evaluativo y cognitivo. Interactúan con la razón, revelándonos el estado de vulnerabilidad que nos es inherente. Hay una larguísima discusión filosófica sobre el papel de dichas emociones en la vida pública-por ejemplo la interesante discusión de Séneca con Aristóteles- y el tema es muy controvertido también en el ámbito de la justicia en general y de la justicia penal en particular, porque se asocian ciertas emociones con una teoría retribucionista y vengativa del castigo. El objetivo del trabajo será proponer una respuesta a dicha posición y delinear una teoría cognitivo-evaluativa de las emociones que no esté directamente conectada con la "venganza", y que pueda ser comprendida en el marco del respeto de los derechos humanos de personas víctimas y victimarias. Human conflicts brought to justice have an irreducible emotional component: we feel anger at the damage, fear of a threat and shame to humiliation. Moral emotions, on the other hand, differ from the basic emotions experienced by non-human animals for their cognitive and evaluative content. There is a lengthy philosophical discussion about the role of these emotions in public life, such as the interesting dialogue of Seneca with Aristotle, and the topic is controversial also in the field of justice in general, and criminal justice in particular, because certain emotions are associated with a retributive theory of punishment. The aim of this study will propose an answer to this position, and outline a cognitive-evaluative theory of emotion that is not directly connected with the "revenge" and that can be understood in the context of the respect of human rights of victims and victimizers.
