Notas sobre o paradoxo dos direitos humanos e as relações hemisféricas

Este artigo discute a tensão entre os dois elementos constitutivos do regime internacional de proteção aos direitos humanos: a afirmação de exigências normativas de caráter universal sobre os direitos subjetivos dos indivíduos e o ordenamento jurídico do Estado democrático, através do qual tais expectativas se traduzem em normas precisas, apoiadas em instituições capazes de zelar por sua efetividade. O artigo trata, portanto, do paradoxo entre o universalismo dos direitos humanos e o particularismo inerente ao Estado. Depois de discutir o tema no plano conceitual, o artigo examina a tensão em dois contextos históricos distintos: os Estados Unidos e a América Latina, extraindo daí algumas ilações a respeito das relações políticas no hemisfério.<br>This article discusses the tension between the two constituent elements of the international regime for the protection of human rights: the universal normative demands on subjective rights of individuals, and the legal order of the democratic state, through which such expectations are translated into definite rules, supported by institutions strong enough to ensure their effectiveness. The article aims, therefore, the paradox between the universalism of human rights and the inherent particularism of the state. After discussing the issue at the conceptual level, the article examines how this tension manifest itself in two distinct historical contexts, the United States and Latin America, extracting from it some lessons about political relations in the hemisphere.
