"La hermanita menor": Concepciones dominantes sobre la seguridad social no contributiva en expedientes judiciales

Este artículo de investigación analiza casos judiciales sobre pensiones no contributivas que llegaron a captar la atención de la Corte Suprema de Justicia de la Nación. Presenta un conjunto de concepciones dominantes sobre estas prestaciones que están presentes en el entramado de actores que dan forma a los expedientes judiciales (principalmente demandantes, burocracias judiciales y del Poder Ejecutivo). La indagación se realizó sobre aspectos materiales de la producción del saber burocrático (los expedientes judiciales). Este tipo de abordaje toma distancia de los frecuentes análisis sobre “la sentencia” como momento central en la creación del derecho. Añadir una visión multiactoral y etapista permite identificar diferentes “emisores” que detentan capital jurídico, redefinen y recodifican derechos y desigualdades. ¿De qué manera los temas “no contributivos” son abordados en los expedientes judiciales? ¿Cuáles son las concepciones dominantes sobre las prestaciones y los principios que justifican (o no) restricciones en el acceso? This article analyzes judicial cases on noncontributory pensions that came to capture the attention of the Supreme Court of Justice of the Nation. It presents a set of dominant conceptions about these benefits that are present in the network of stakeholder that shape judicial files (plaintiffs, judicial bureaucracies and the executive branch). The inquiry was conducted on material aspects of the production of bureaucratic knowledge (judicial files). This type of approach takes distance from the frequent analysis on “the sentence” as the central moment in the creation of the right. Adding a multi-stakeholder vision and staging allows identifying different “issuers” that hold legal capital, redefine and recode rights and inequalities. How do judicial records incorporate “non-contributory” issues? What are the dominant conceptions of benefits and the principles that justify (or not) restrictions on access?
