Artificial intelligence is becoming a part of everyday life. The more it applies, the more it finds itself in the activities of the state. The state seeks to exploit the potential of artificial intelligence and with its help to simplify, streamline, and reduce costs. This also applies to the implementation of artificial intelligence in public administration decision-making. In this article, we discuss the possibilities of using artificial intelligence in decision-making processes in public administration in cases where administrative discretion is required or is even necessary. First of all, our attention is paid to current trends in the use of weak artificial intelligence based on rules in administrative decision-making processes. Next, we discuss the possibilities of using strong artificial intelligence based on machine learning and its limits in terms of the implementation of administrative discretion. Finally, we also formulate the necessary legislative requirements to ensure the legality and legitimacy of such a process.
