The Act of 5 November 2025 on collective labour agreements and agreements amending, inter alia, Article 6720 of the Labour Code has established a significantly broader framework for determining the rules governing the performance of remote work. In addition to the previously available agreements on remote work, this matter may now also be regulated in collective labour agreements and supplementary protocols thereto. The present article focuses primarily on issues related to the conclusion of agreements on remote work. The point of departure for the subsequent analysis is the question of their legal nature within the system of labour law. De lege lata, such agreements have the status of “other agreements” within the meaning of Article 9 § 1 of the Labour Code and therefore qualify as sources of labour law.
