Acceso a recursos genéticos y distribución de beneficios en Colombia: desafíos del régimen normativo

La investigación analiza los retos que presenta el régimencolombiano sobre acceso a recursos genéticos y distribución debeneficios mediante la utilización del método jurídico, con unenfoque descriptivo, comparativo y propositivo. El mecanismo deacceso y distribución de beneficios pretende desacelerar la pérdidade diversidad genética, entre otros fines. El marco legal se encuentraincompleto y no sistematizado. Asimismo, el procedimiento de accesoa recursos genéticos surge burocrático e ineficiente y obstaculizaasí la investigación de la biodiversidad del país. Afortunadamente, lareciente simplificación del procedimiento para investigar recursosgenéticos con fines no comerciales podría ayudar a resolver el mencionadoproblema para este tipo de proyectos. Además, la consultaprevia articulada para el acceso a recursos genéticos ubicados enterritorios de las comunidades indígenas y negras no garantiza laefectiva participación de aquellas. Por último, las medidas de cumplimientoestablecidas, que circunscriben el control al acatamientode la legislación colombiana y la de los países andinos, no satisfacenlas disposiciones del Protocolo de Nagoya al respecto The research analyzes the implementation challenges the Colombian regime on access to genetic resources and benefit-sharing presents through the use of the legal method and a descriptive and comparative analysis. The access and benefit-sharing regime intends to slow down biodiversity loss amongst other goals. The regime appears incomplete and not systematized. Also, the procedure for access to genetic resources emerges excessively bureaucratic and inefficient, hindering biodiversity scientific research in the country. Fortunately, the recent simplification of the procedure for conducting research on genetic resources for non-commercialpurposes could help solve the problema at least for these kind of projects. Likewise, the established consultation to indigenous and black communities for the access to genetic resources located in their territories does not guarantee their effective participation. Finally, established compliance measures only cover compliance with the Colombian law and that of the Andean countries; therefore they do not satisfy the provisions of the Nagoya Protocol.
