This paper addresses the challenges associated with the implementation of the principle of party presentation and other related procedural principles, which generally limit both the parties to the case and the court in the process of building the factual basis for a decision on the merits. The possibility of consistent application of the relevant principles of civil litigation will be examined in proceedings for the dissolution and settlement of co-ownership and the settlement of matrimonial property, which are unique to the fact that the court is bound by the substantive provisions of the Civil Code in the process of adopting a decision on the merits. The purpose of this paper is to provide answers to the practical dilemmas outlined above on the basis of the de lege lata provisions of the Code of Civil contentious proceedings.
