La Iglesia católica y la laicidad educativa en Argentina : de la Ley Federal de Educación a la Ley de Educación Nacional

La configuración normativa actual del sistema educativo argentino puede ser interpretada, en términos de laicidad educativa, como la sedimentación de una cultura política generada en una historia de tensiones, disputas y reconocimientos entre el Estado y la Iglesia católica. En ese marco, el objetivo de este trabajo es analizar el posicionamiento de la Iglesia católica ante la discusión y sanción de la Ley de Educación Nacional (LEN) sancionada en 2006, luego de trece años de vigencia de la Ley Federal de Educación (LFE). Para emprender el seguimiento de las continuidades y cambios en la transición entre ambas normativas, se realizó una lectura de documentos de la Iglesia argentina así como de la prensa educativa editada por el Consejo Superior de Educación Católica. La lectura de las estrategias interdiscursivas puestas en juego permite dar cuenta de las tensiones y disputas por los sentidos del Estado, la educación pública y el lugar de la religión en el sistema educativo nacional. Si bien el discurso estatal plasmado en la LEN fue permeable a la inclusión de preceptos educativos católicos también presentes en la LFE, también operó en línea con un distanciamiento respecto del ideario católico al incluir nuevos temas que habían sido suprimidos del orden discursivo oficial. El espacio normativo de la educación pública se reconfiguró así a partir de una nueva polifonía que tomó algunas de las demandas católicas cristalizadas a lo largo de los años, pero que también incorporaba nuevas demandas propias de un nuevo clima cultural. The current normative configuration of the Argentine educational system can be interpreted, in terms of educational laicity, as the sedimentation of a political culture generated in a history of tensions, disputes and recognitions between the State and the Catholic Church. In this framework, the aim of this paper is to analyze the positioning of the Catholic Church before the discussion and sanction of the National Education Law (LEN) sanctioned in 2006, after thirteen years of the Federal Law of Education (LFE). In order to follow the continuities and changes in the transition between both regulations, a reading of documents of the Argentine Church as well as of the educational press edited by the Superior Council of Catholic Education was made. The reading of the interdiscursive strategies put into play makes it possible to account for tensions and disputes over the senses of the State, public education and the place of religion in the national educational system. While the State discourse embodied in the LEN was permeable to the inclusion of Catholic educational precepts also present in the LFE, it also operated in line with a distancing from the Catholic ideology by including new topics that had been suppressed from the official discursive order. The normative space of public education was thus reconfigured from a new polyphony that took some of the Catholic demands crystallized over the years, but also incorporated new demands of a new cultural climate.
