Argumenta-se que a teoria sistêmica de Luhmann e a teoria do discurso de Habermas podem ser vistas como interpretações complementares da realidade jurídica e política do Ocidente desenvolvido. Aplica-se isto à análise do direito na "modernidade periférica", representada pelo caso brasileiro.<br>Luhmann's "systemic" and Habermas' "discourse" theories may be seen as complementary interpretations of the juridical and political reality of the developed West This point is presented and developed regarding the role of right in the "peripheric modernity", represented by the Brazilian case.
