Entendiendo el rol del Tribunal Internacional del Derecho del Mar en el Sistema de Solución de Controversias de la Convención de Naciones Unidas sobre el Derecho del Mar : Understanding the Role of the International Tribunal for the Law of the Sea in the Dispute Settlement System of the United Nations Convention on the Law of the Sea

La existencia del Tribunal Internacional del Derecho del Mar en el sistema de solución de controversias no ha estado exenta de cuestionamientos. Nos proponemos en el presente artículo, argumentar que el Tribunal ha sido creado con una clara finalidad, en respuesta a demandas existentes en la comunidad internacional. Comenzamos estableciendo la relación entre la multiplicación de jurisdicciones internacionales con la expansión del derecho internacional. Luego se describe el sistema de solución de controversias en el derecho del mar, y se analiza la competencia del Tribunal, comparándola con aquella de la Corte Internacional de Justicia. Este recorrido nos permite aseverar que el Tribunal, considerando su rol en el sistema, cumple una función única y se está consolidando como fuero. Su jurisprudencia ya ha establecido importantes criterios en cuanto a la interpretación del derecho internacional. The existence of the International Tribunal for the Law of the Sea in the dispute settlement system has not been exempt of questioning. In the present article, we argue that the Tribunal has been created with a clear goal, as a response to the needs of the international community. We begin establishing the relation between the multiplication of international jurisdictions and the expansion of international law. Afterwards, the dispute settlement system in the law of the sea is described, analyzing the competence of the Tribunal, comparing it with the competence of the International Court of Justice. This path will allow us to affirm that the Tribunal, considering its role in the system, has a unique function and it is consolidating as a forum.
