La autonomía municipal

Ha sido largo el camino que se debió transitar en nuestro país para jerarquizar y modernizar al municipio, evolución que se dio en lo político, en lo institucional, en lo administrativo y en lo financiero, lo cual benefició en el tratamiento de las políticas públicas, las que en definitiva redundan en beneficio del vecino. De igual manera que las constituciones provinciales fueron reformadas desde 1986, para adaptarlas a las nuevas realidades de la democracia, el régimen municipal también fue objeto de importantes cambios en el constitucionalismo provincial que nace a partir del retorno a la legalidad institucional en la década del ochenta. Se logra el reconocimiento al municipio como entidad jurídica, política y como una comunidad natural con vida propia e intereses específicos, consagrándose, además, la independencia del gobierno municipal ante todo otro poder provincial. Al respecto, cabe destacar el caso de la Provincia de Buenos Aires que modifica su constitución con posterioridad a la reforma constitucional nacional -incorpora el artículo 123-, pero mantiene en cuanto al régimen municipal aquello que expresaba su texto de 1934. Sin duda se han conseguido importantes logros a nivel de crecimiento, modernización, jerarquización y reconocimiento de la autonomía municipal a nivel constitucional, pero sin lugar a dudas, está muy lejos de verse agotado el camino por recorrer en este tema. The way has been long in our country due to hierarchize and streamline the municipality, development which occurred in the political, institucional, administrative and financial aspects, which benefited in the treatment of public policy which ultimately redound to the benefit of the neighbour. Just as the provincial constitutions were reformed since 1986, to adapt them to new realities of democracy, the municipal system was also object of important changes in provincial constitutionalism that born from the return to the institucional legality in the eighties. Recognition is achieved to the municipality as a legal entity, political organization and a natural community with own life and specific interest, devoting itself, in addition, the independence of the municipal government first of all another provincial power. In this regard, it is possible to emphasize the case of the Province of Buenos Aires, that modifies its constitution after the national constitutional reform –introduce article 123- but remains as to the municipal system that expressed his text of 1934. No doubt it has been reached important achievements concerning growth, modernization, hierarchial and recognition of municipal autonomy in the constitution, but without doubt, is far from being finished the way to go in this subject.
