Sociología Jurídica Reflexiva: sus posibilidades teóricas a partir de “la complejidad” y “las necesidades humanas”

El presente texto intenta introducir la noción un programa teórico complejo en el área de la Sociología Jurídica Reflexiva para tratar los nuevos movimientos sociales y la transformación en el campo jurídico. De este modo el texto es un intento por encontrar y sistematizar aportes teóricos y fenómenos sociales que posiciona y dan autonomía en el área mencionada, como una confluencia y concurrencia de modelos, estudios y teorías algunas en debate pero que todas sumadas en una suerte de paradigma admiten una construcción en donde se cimienten los estudios empírico para confirmar: i- la consolidación y la expansión socio-jurídica del concepto de ciudadanía plena (desde las teorías subjetivistas a la estructuración concretada en la vigencia de legislación que logre los principios de los derechos humanos) y i- el asegurar la plena existencia socio-cultural de diversas subjetividades, identidades y colectivos tomando como punto de partida y meta los derechos humanos. Se busca reflexionar sobre las relaciones que ponen a prueba a la institución jurídica y especular como imaginar estructuras teóricas que permitan formular preguntas, contener análisis, conducir los estudios empíricos a diferentes respuestas y comprometer al académico con el proceso de transformación social y cultura. This paper attempts to introduce a theoretical notion in the complex area of the reflexive Sociology of Law to treat the new social movements and the transformation in the legal area. This text is an attempt to find and systematize theoretical contributions and the social’s phenomenon, that positions and given autonomy in that area, as a confluence and concurrency of models, studies and some debated theories but that all combined in a kind of support to admit a construction paradigm where lays of the empirical studies to confirm: i-the socio-legal consolidation and expansion concept of full citizenship (from subjectivist theories from the structure as expressed in the validity of legislation that achieves the principles of human rights) and ii-the ensuring full socio-cultural existence of various subjectivities and collective identities, taking as a starting point and aim of the human rights. It seeks to reflect on the relationships that test the legal institution and speculate how to imagine theoretical structures to allow formulate questions, contain analyzes, lead empirical studies to different answers and engage the academic person with the process of social and culture transformation.
