The most important objective of this work is to expose the main theories and studies, especially quantitative ones that have been used in the first stage of the work plan 2011- 2013, with the aim of getting the degree of Doctor in Humanities (Law) at the Universidad Nacional de Tucumán. The research called “Discrimination by the state in relationship to the right to water in the hard nucleus of poverty in the Grand North of Argentina” proposes to analyse and to determine the configuration of discrimination by the state in relationship to water as a basic human right in populations under hard poverty situation in the provinces of Tucuman and Santiago del Estero. The concepts of “territorial poverty” and “belonging to original peoples” were rebuilt as suspicious categories of discriminatory practices. At the same time the right to water was selected as the main affected right for such practices. The statistical dimension of the violations of this right, in the hard nucleus of poverty, sets up the first step to disarticulate and make visible the discriminatory practices. The outcomes revealed that in these populations: 23% of homes have water inside the house; 42,8% of homes have water outside the houses; 33,6% of homes have water outside the land and 14% of homes provide themselves with water by creeks or water tanks. Taking into account statistics and common international standards limited by the General Observation Nº 15 (ESCR Committee), it is concluded in the first stage of the research that the needs of access and no discrimination in relationship to the right to water are not respected nor satisfied, showing a serious damaging to fundamental rights to people in poverty situation. El objetivo primordial de este trabajo es exponer las principales teorías y estudios esencialmente cuantitativos que se utilizaron en la primera etapa del plan de trabajo, 2011 – 2013, con la finalidad de obtener el título de Doctora en Humanidades (Área Derecho) en la Universidad Nacional de Tucumán. La investigación doctoral titulada “Discriminación estatal en relación al derecho humano al agua en los núcleos duros de pobreza del Norte Grande Argentino”, se propone analizar y determinar la configuración de la discriminación estatal en relación al derecho humano al agua en las poblaciones de los núcleos duros de pobreza situadas en las provincias de Tucumán y Santiago del Estero. Se reconstruyeron como categorías sospechosas de las prácticas discriminatorias los conceptos de “territorialización de la pobreza” y “pertenencia a un pueblo originario”. Asimismo se seleccionó el derecho humano al agua como principal derecho afectado por dichas prácticas. La dimensión estadística de las violaciones a este derecho, en los núcleos duros de pobreza, constituye el paso inicial para desarticular y visibilizar las prácticas discriminatorias. Los resultados obtenidos por las investigaciones locales revelaron que en estas poblaciones: 23 % de hogares tienen agua adentro de la vivienda; 42,8 % de los hogares tiene agua fuera de la vivienda; el 33,6 % de los hogares tiene agua fuera del terreno y el 14 % de los hogares se provee de agua de arroyo o cisterna. Considerando las estadísticas y los estándares internacionales, marcados en general por la Observación General Nº 15 (Comité DESC), concluimos en esta primera etapa de investigación que los requisitos de accesibilidad y no discriminación en relación al derecho humano al agua no son satisfechos ni respetados, indicando una grave vulneración a los derechos fundamentales de las personas situación de pobreza.
